1. Acceptance of Terms

By accessing and using DoseAI (“the Service”), you accept and agree to be bound by the terms and provision of this agreement. If you do not agree to abide by the above, please do not use this service.

2. Description of Service

DoseAI is a medication management platform that provides medication tracking, reminders, AI-powered medication scanning, health information, and related services through our mobile application and web platform. The Service is designed to help users manage their medications. Certain features of the Service use artificial intelligence powered by third-party providers, as described in the “AI-Powered Features” section below.

3. User Accounts

To access certain features of the Service, you must register for an account. You agree to:

• Provide accurate, current, and complete information during registration
• Maintain the security of your password and identification
• Notify us immediately of any unauthorized use of your account
• Accept responsibility for all activities under your account

4. Acceptable Use

You agree not to use the Service to:

• Violate any applicable laws or regulations
• Transmit any harmful, threatening, abusive, or defamatory content
• Impersonate any person or entity
• Interfere with or disrupt the Service or servers
• Attempt to gain unauthorized access to any part of the Service
• Use the Service for any commercial purpose without authorization

5. Health Information Disclaimer

The information provided through the Service is for informational purposes only and should not be used for diagnosing or treating a health problem or disease. We do not recommend or endorse any specific tests, physicians, products, procedures, opinions, or other information mentioned on the Service.

AI-generated responses about medications (including interaction checks, dosage information, and general health information) are provided for informational purposes only and may contain errors. Always verify AI-generated information with your healthcare provider before making any medical decisions.

6. AI-Powered Features and Third-Party Data Processing

The Service includes AI-powered features that use third-party artificial intelligence services. By using these features, you acknowledge and agree to the following:

6.1 Third-Party AI Provider

AI-powered features (including medication label scanning, AI chat, and automatic form filling) are powered by OpenAI (OpenAI, L.L.C.). When you use these features, certain data is sent to OpenAI for processing as described in our Privacy Policy.

6.2 Consent Required

Before any data is sent to OpenAI, we will ask for your explicit consent through an in-app dialog. You may decline or revoke this consent at any time in the app's Settings screen. If you decline, AI-powered features will be disabled but all other Service functionality will remain available.

6.3 Data Sent to OpenAI

When you use AI-powered features with consent, the following data may be sent to OpenAI:

• Photos of medication labels and packaging for text recognition
• Medication names, dosages, and related details from your library
• Questions you type in the AI chat feature

Your name, email, account credentials, and other personal identifiers are NOT sent to OpenAI.

Data sent to OpenAI via their API is subject to OpenAI's API data usage policies. As of the date of these Terms, OpenAI does not use API data to train their models and retains it for up to 30 days for abuse monitoring. For details, see OpenAI's API data usage policies.

7. Privacy and Data Protection

Your privacy is important to us. Our collection and use of personal information is governed by our Privacy Policy, which is incorporated into these Terms by reference. By using the Service, you consent to the collection and use of your information as outlined in our Privacy Policy.

8. Intellectual Property

The Service and its original content, features, and functionality are owned by DoseAI and are protected by international copyright, trademark, patent, trade secret, and other intellectual property laws. You may not copy, modify, distribute, sell, or lease any part of our Service.

9. User-Generated Content

By submitting content to the Service, you grant DoseAI a non-exclusive, worldwide, royalty-free license to use, copy, reproduce, process, adapt, modify, publish, transmit, display, and distribute such content in any and all media or distribution methods.

You retain ownership of your content, but you represent and warrant that:

• You own or have the necessary rights to the content
• Your content does not violate any third-party rights
• Your content complies with these Terms

10. Termination

We may terminate or suspend your account and access to the Service immediately, without prior notice or liability, for any reason, including if you breach these Terms. Upon termination, your right to use the Service will cease immediately.

You may also terminate your account at any time by contacting us or using the account deletion feature in the application.

11. Disclaimers

The Service is provided on an “AS IS” and “AS AVAILABLE” basis. DoseAI makes no representations or warranties of any kind, express or implied, regarding the Service, including but not limited to:

• The Service will meet your requirements
• The Service will be uninterrupted, timely, secure, or error-free
• The results obtained from the Service will be accurate or reliable
• Any defects in the Service will be corrected

12. Limitation of Liability

In no event shall DoseAI, its directors, employees, partners, agents, suppliers, or affiliates be liable for any indirect, incidental, special, consequential, or punitive damages, including without limitation, loss of profits, data, use, goodwill, or other intangible losses, resulting from your use of the Service.

13. Indemnification

You agree to defend, indemnify, and hold harmless DoseAI and its licensee and licensors, and their employees, contractors, agents, officers and directors, from and against any and all claims, damages, obligations, losses, liabilities, costs or debt, and expenses (including but not limited to attorney's fees).

14. Governing Law

These Terms shall be interpreted and governed by the laws of the jurisdiction in which DoseAI is incorporated, without regard to its conflict of law provisions. Any disputes arising from these Terms or the Service will be resolved in the courts of that jurisdiction.

15. Changes to Terms

We reserve the right to modify or replace these Terms at any time at our sole discretion. If a revision is material, we will try to provide at least 30 days' notice prior to any new terms taking effect.

Your continued use of the Service after we post any modifications to the Terms constitutes acceptance of those changes.

16. Severability

If any provision of these Terms is held to be unenforceable or invalid, such provision will be changed and interpreted to accomplish the objectives of such provision to the greatest extent possible under applicable law, and the remaining provisions will continue in full force and effect.

17. Entire Agreement

These Terms constitute the entire agreement between you and DoseAI regarding the Service and supersede and replace any prior agreements we might have had between us regarding the Service.
